Photoshop: Why does the crop tool change the background layer to "Layer 0"?

In my typical workflow, when using the new CS6 crop tool to quickly expand the canvas on the fly, 95% of the time I want my "background" layer to stay an actual background layer.I don't want transparency.When I have the bottom-most layer set as a flat background layer - why assume I suddenly want it to be a normal moveable layer?After cropping/expanding I'm now constantly selecting my altered background layer and converting it back into a "real" background layer.

Because you have the crop tool set to preserve the cropped areas, which changes your document into a layered document.

In the Crop tool options bar, enable "Delete Cropped Pixels"
