When Scripting the Select Subject command (autoCutout) the dialogMode is ignored

If I write a Photoshop script (or use an Action) to call Select Subject and I pass in DialogModes.NO to ensure that no dialogs show, and Select Subject fails to identify a subject, a modal dialog shows stating "We couldn't find a subject to select in this layer..." User Interaction is required to clear this dialog, and resume script execution.
Ideally Select Subject should respect DialogModes.NO and throw a catchable error, that the script could handle.
