Photoshop CS6: swatch colors are always gray (grayscale document)

I created a new layer with mask using magic wand, then when trying to switch colors to paint it comes up with grey no matter which color i select for foreground or background colour. However if I open another file I have no problems

Is the Layer selected or the Layer Mask (see Layers Panel)?

Is the image grayscale?
Are you in Quick Mask Mode (Q)?
Could you please post a screenshot with the Layers and Channels Panels visible?

tried taking it out of quick mask mode still the same (thank you for your help)

so it won't let me use the paint brush to paint overtop in color

Are you unfamiliar with Grayscale?
Painting with color necessitates a document in an appropriate Color Mode naturally.
