Photoshop: Save as .psd with Layers, NOT As a Copy default action

My request/problem is to change a default action in the Save As window.

The problem comes in after saving a file where the action changes the Check box to "As a Copy" (ie save as a .pdf deselecting Preserve PS Editing Capabilities)

When going back to the Save As window again, the Save: options change to "As a Copy" regardless of what you had before. So now when selecting Format: Photoshop .psd the Save: option stays as "As a Copy"

This should flick to "Layers" once the Format: .psd is selected again.
As anyone who uses any program enough, we can all attest to quickly going through steps with a few keyboard presses or mouse clicks where a window might be up for less than a second... not enough time to see that "As a Copy" may still be selected.

Closing the file causes the user to loose all their layers.

Please Please make this change. I have Lost too many working files due to this.

I can't think of any reason why someone would want a Flat .psd file. and if there is a reason, I'm sure that the few people who do do that on purpose would be happy to choose As a Copy on that rare occasion.
