I submitted a request via the phone and the online form and submitted my receipt over a week ago. I have updated my request asking for some sort of acknowledgement. No response whatsoever. How long can it take to verify a receipt and tell a customer yes or no?

That's not exactly correct. My "Open Cases" still says "Open - Pending Adobe Response" and has said that for over a week. And, each time I inquire I get the same answer, but that's where it ends. Also, the email I received when I submitted for the free upgrade as advertised states that "if approved for a free upgrade" that I would receive a "link by email to download the upgrade". Its frustrating that I cannot get a straight and accurate response.

There is still an order process, even for download versions of the software, and shipping in these cases refers to when you are able to download. The order has been placed, but some administrative task or other seems to be holding the process up. I've brought this to the attention of parties that can get this cleared up so you will be able to download the software as soon as possible.

I bought CS5 just a few weeks ago, only to be told recently that CS6 is for sale. Wouldn't it be fairer to let customers know this before purchase, or at least offer customers in my position an upgrade at a nominal fee?

While we have a target date for release, nothing can be written in stone. There can be unforeseen delays at the last second that pushes everything back a day, a week, a month. So nothing can be promised up front.
But we made a number of announcements that CS6 was coming soon, especially Photoshop, we certainly weren't shy on that front. There was a Public Beta available to everyone for over a month before the release.
