how do i create a new image layer or hw do i add an image to a open file?

Are you using Photoshop CS5 or are you using the Photoshop Express editor on Photoshop.com? If it's the later, Photoshop.com's Express editor doesn't support layers. You would need to use and application like Photoshop Elements or Photoshop CS5. You can download a free trial version of those products here: http://www.adobe.com/downloads/

I am having trouble getting the layers function to work in elements 10. When I click the layers in the upper bar nothing highlights and when I try to duplicate a layer nothing happens.

In Elements, you can simply drag an image from the project bin and drop over the opened image. It will automatically create new layer.

Are you trying to duplicate the layer from the Layers pallete at right hand side? Also, is there enough space on your disc?
