i am trying to merge two photos and i have been watching videos about layers but i dont know how to create the layers?

you can hit ctrl+shift+n to create new layer and hit ctrl + j to duplicate current layer.

that didn't work! does it depend oh what type of photoshop I have? is there another way?

If you have this suspicion why don’t you just tell us which version you use (also platform)?
If you want to get one image as a layer in another file, open both, select all (Select > All), copy it (Edit > Copy), close this image (File > Close), paste (Edit > Paste) with the other image active (as it should be if you opened both).

some shortcuts depends your installation language. go to edit -> keyboard shortcuts to learn shortcut keys.
