Photoshop: Freeform Pen Tool not staying on Shape setting

I'm a high school art teacher and I'm doing a lesson with the freeform pen tool with my students. I have the students recreate a photo of a person using the freeform pen tool with the standard settings set. They are to ink drop a color from their reference image draw the shape that color makes and then click back onto the reference image and repeat. However I have a student that every time he clicks back to his reference image the freeform pen tool setting changes from shape to path. Anyway of having it stay on shape?

Any chance the sample color was made with the pen tool and not shape. Maybe it's detecting it and switching. Try giving him one of the other students reference file.

I'd need better steps to repro. It sounds like it's either system or file specific. If the student uses a different file (as Steven suggests) does it work? If the student uses a different computer, does it work correctly for him. This information might give us more clues where the problem resides.

This is the assignment if this helps at all. No he is using the freeform pen tool and selecting the color while on the freeform pen tool. We tried saving it under a new name and that didn't do anything. We don't have any open computers for this student to switch his work over to another one.
