Photoshop: File extension are not in small letters (as choosen) when I save as.. without changing the file name.

Why are my file extensions not in small letters anymore when I don't change the filename?

i.e. I open a JPG file (TEST.JPG), work on it, save it as JPG again with the same filename. Say yes to overwrite. In older version of Photoshop (PS3) it changed now the extension to small letters as checked in the preferences. Now (PS 5) it keeps the big letters. Maybe because the filename doesn't really change.
But I used it to recognize pictures I already worked on.

Photoshop 3 and 5 are pretty old.

Which product and version are you actually using?
Which OS version are you using?

OSX 10.7.5 with PS CS5.1

But problem also exists in PS 6
