Eyedropper Photoshop CC does not work for fore/background swatches while in a modal dialog

I can no longer select my background color in photoshop and eyedrop the foreground color to pick a variation on this. How can the eyedropper be broken like this?

Which specific version of Photoshop are you using?
What OS version are you using?
What exactly happens when you use the eyedropper tool?

- Windows 10 Pro
- When I double click the foreground color to adjust it, the color picker opens. Normally, while having the color picker popup open, I could use the cursor, which would transform into an eyedropper, to color pick various colors, including the foreground and background color.
While I can color pick any color in the document, I cannot pick the foreground OR background color. It just doesn't work...

OK, so this is only limited to reading the foreground and background swatches while you are in a modal dialog.

This is correct
