CS 5 Eyedropper tool- does not function correctly

PhotoShop CS 5 in Mac OS Lion. Ever since I first upgraded to CS5 (in Snow leopard) I have had problems with the eyedropper tool.
1) If I have the tool selected and try to click on any of my palettes (other than color swatches), I am unable to select any items- such as layers, paths, channels, into, etc. I need to take another tool first.
2) When trying to change a color in an index file, I can not select another color with the default eyedropper tool (without using a work around which I learned here- clicking on the white space in the dialogue box before selecting the color.)

I was hoping this would be fixed in a updater or when I upgraded by system to Lion. That does not appear to be the case.

Did you install all the Photoshop updates? You should be on at least version 12.0.4 or 12.1.

I did install the update 12.0.4 A while ago. I checked to see if there was a further one (Help> Updates). It says I am up to date.

Since I first posted this problem (7/16/2011) and was given the work-around by Jeffrey Tranberry, I have reinstalled the app from scratch. The problem has existed through all of this. (But I am grateful to Jeff for the workaround.)

I also recently installed CS 5 (version 12.0.4 x64) on my brand new MacBookPro. (It is running Snow Leopard). The problem exists there too.

Where can I get the update to 12.1? Perhaps that fixes the problem?

12.1 is the same as 12.0.4, but was part of CS 5.5.

And double check your version numbers - if you reinstalled, then you reset it back to 12.0.0, and need to reinstall the updates.

I did, and I have. (FYI- not a newbie here- been using PS since version 2.1)

Both computers are running 12.0.4 x64. One is Lion (MacPro Tower) & the other in Snow Leopard (MacBookPro).
And both have the same problems with the eyedropper tool.

FYI- I had a freelancer bring her MacBookPro laptop to my studio the other day.
She has never worked with me before & has all her own software (CS 5.5).

She was able to recreate this same bug with the eyedropper tool. So this is an official bug for CS 5 & CS 5.5.

Today I upgraded to CS 6. The problem does NOT exist within CS 6 (13.0.1).
So thanks to the team that fixed that.
