Photoshop CS5: Can not click in panels, like Layers, with eyedropper tool selected

In PS CS 5 the Eyedropper tool- when you have this tool you can not click in the inspector windows, like layers, color palettes, etc. I have to switch tools to access these. This is a bug.

I am running Mac OS 10.6.8 on a quad core Pro Tower with 10 Gig ram & 3 teribybe exclusive scratch disk.

Do you have all the updates installed? http://adobe.ly/PS-Up-To-Date

Have you tried restoring your prefs? http://adobe.ly/PS_Prefs

What sort of input device are you using? (Mouse, trackpad, tablet?)

Yes, I have 12.0.4 x64
I have thrown out the prefs and restarted.
I am using an Apple Magic Mouse.

It worked when I tested it, but only time will tell.

Yes for now- I will see if this happens again. The bug I had reported earlier (that you gave me a work around) still exisits. This is where I am in index mode editing the colors and have to click above the color window with the eyedropper before using it to get a color from another source. Thanks for your help!
