Photoshop: Batch action doesn't run on all files in Photoshop cc

If i run a batch action via File/automate/batch on more than one opened images in Photoshop CC the batch isn't carried out on all the opened images. In this case the action is "flatten image" on 13 opened images. I ran into this problem a few times with photoshop cc, never with the older versions.

Do you have an action and batch of files that exhibit this behavior consistently you can share with us?

Of specific steps to reproduce?

It happens for me as well, on every batch action I've run, from a simple Flatten command on up to a 30 step command. It seems to run TWICE on some images (randomly, no specific pattern of which images it does it on) and thus "skip" several images.

I ran in to it again on a differend set of files. I can't share the files since they are from a client and confidential.
How do I send you the batch .atn file?

I use OS 10.6.8
