Photoshop CS6: eyedropper tool’s current & below setting misbehaviour

The Eyedropper Tool, set to Current & Below, seems to fail if the active Layer is situated in a Group with Blend Mode Normal and one tries to pick a color from Layers below that Group.
Whether this is a bug or just unexpected behaviour may be debatable, but for me as a user this makes the new color picker settings much less usefull.

The issue appears to be that the Group is at the top level of the layers panel. If you add a blank layer above the Group the eyedropper should work as expected.

No, as far as I can tell the problem is that the Group containing the active Layer is set to another Blend Mode than »Pass Through«.
Adding a Layer above the Group has no effect for me.
